Rajasthan HC allows Bail to Chartered Accountant accused of Rs. 100 Cr GST Scam [Read Order]

The High Court of Rajasthan allowed the bail to the person alleged to have created fake invoices to wrongfully availing input tax credit (ITC).

The matter pertains to claims of the wrong input tax credit on the basis of fake bills.

The allegation against the petitioner, Anup Ashopa who is a Chartered Accountant is of making fake firms who later on claimed the input tax credit. The input tax credit pertaining to their firms was more than Rs.100 crore.

The applicant contended that as many as 21 fake firms were corporated and an input tax credit of more than Rs. 100 crore was claimed by Vijay and Kapil who has been enlarged on bail by Coordinate Bench of the Court.

The Counsel for the department has opposed the bail application. It is contended that the petitioner was instrumental in incorporating fake firms. He had obtained documents and had incorporated fake firms for the purpose of claiming the input tax credit.

The single-judge bench of Justice Pankaj Bhandari allowed the bail to the person alleged to have created fake invoices to wrongfully avail Input Tax Credit (ITC).

“It is directed that accused-petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- together with two sureties in the sum of Rs.50,000/- each to the satisfaction of the Trial Court with the stipulation that he shall appear before that Court and any Court to which the matter be transferred, on all subsequent dates of hearing and as and when called upon to do so,” the HC said.
