The Rajasthan High Court has ordered that the Rajasthan Real Estate Appellate Tribunal must become operational at earliest and positively by April 1, 2021.
The applicant, Nipun Singhvi has filed the writ petition seeking directions to respondent State alleging inaction by the respondent State in constituting and establishing the Rajasthan Real Estate Appellate Tribunal, Jaipur under Section 43 of the Real Estate (Regulation and Development) Act, 2016.
Post filing of the present writ petition a notification dated February 26, 2021 has come to be issued constituting and establishing the Rajasthan Real Estate Appellate Tribunal, Jaipur.
The petitioner does not press the present writ application except the prayer for direction to the respondent Urban Development and Housing Department to ensure that the Rajasthan Real Estate Appellate Tribunal, Jaipur becomes functional at the earliest.
The division bench of Justices Satish Kumar Sharma and Indrajit Mahanty directed the Government of Rajasthan, Urban Development and Housing Department to ensure that the Rajasthan Real Estate Appellate Tribunal, Jaipur becomes operational at the earliest and positively by April 1, 2021.
