The Rajasthan High Court granted relief to the Chartered Accountant associates by ordering the immediate release of documents impounded by the Income Tax Department after six-years.

The writ petition was filed in 2017 by the petitioner, M/s. N. Sarda and Associates, through its partner. The petition challenged the actions of the respondents, The Director General Of Income-Tax Investigation, The Principal Director Of Income-Tax Investigation, The Assistant Director Of Income-Tax Investigation and The Income-Tax Officer Investigation  who had impounded various documents belonging to the petitioner.

When the case was heard by the Justices Mannuri Laxman and Manindra Mohan Shrivatsava, the petitioner’s counsel asserted that no proceedings are currently pending and that all assessments were completed long ago.

The respondents’ counsel acknowledged this assertion made by the petitioners and suggested that the writ petition could be resolved with a directive to the authorities.

Considering the submission and placing on record the statement made by counsel for the petitioner, as of now, the division bench of Rajasthan High Court directed the respondents to release the seized documents immediately, provided no proceedings are pending. The petition was allowed accordingly.

Mr. Kamlesh Kumar Rawal and Mr. K.K. Bissa appeared for the Petitioner and respondents respectively.
