The Division Bench of the Supreme Court comprising Justice B.V. Nagarathna and Justice UjjalIndia has granted relief to Vodafone Idea upholding the dismissal of the appeal filed with a delay of 2472 Days.

N Venkatraman appeared on behalf of the revenue.

The Division Bench of Calcutta High Court had dismissed this appeal observing that, “We have perused the affidavit filed in support of the condone delay petition and we find that the delay has not been explained and sufficient cause has not been shown by the appellant department for not having filed the appeal within the period of limitation. The delay being inordinate and unexplained we are unable to exercise any discretion in favour of the appellant.”

The Bench while condoning 156 days of delay in filing a special leave petition has observed that the High Court was justified in dismissing the appeal filed with a delay of 2472 days and was not inclined to interfere in the matter.
