The Calcutta High Court rejected the bail application in the Rose Valley Money Laundering and ordered the Enforcement Directorate (ED) to arrange for the treatment for the accused suffering from Vocal Chord Cancer.

In the case of Arun Mukherjee Vs. Enforcement Directorate, Government of India the petitioner filed the bail application on the grounds of his medical ailment because Enforcement Directorate (ED) is ready to meet all expenditures on account of medical treatment through Super Speciality Hospitals in West Bengal which can be availed through the Superintendent Presidency Correctional Home.

The petitioner namely Arun Mukherjee filed the bail application wherein the petitioner contended that he is diagnosed as a carcinoma patient and was having an abnormal growth in his left vocal cord and the operation took place at Woodland Hospital, Kolkata to remove the squamous carcinoma cell. The petitioner is also suffering from Diabetes Mellitus and hypertension with IHD for which he was also admitted to PCH Hospital since and has acute pain in his hip joint and lower leg and suffering from degenerative disc disease with secondary spinal canal stenosis at L4-L5.

As a consequence, it was argued that the accused is in the dire need of specialized medical treatment.

The issue raised in this case was whether the accused can be granted bail on the grounds of his medical ailment or not?

The Single Judge of High Court of Calcutta consisting of Justice Shivakant Prasad after taking the note of the contention of the Enforcement Directorate that the Enforcement Directorate is ready to meet all expenditure on account of medical treatment through Super Speciality Hospitals in West Bengal which can be availed through the Superintendent Presidency Correctional Home. The court rejected the bail application in the Rose Valley Money Laundering and ordered the Enforcement Directorate (ED) to arrange for the treatment for the accused suffering from Vocal Chord Cancer.
