SC refuses to Intervene Plea Postponing CA Exams 2024 amidst Lok Sabha Election

The Supreme Court refused to intervene plea for postponing the Chartered Accountant Exams ( CA exam ) 2024 conducted by the Institute of Chartered Accountants of India ( ICAI ) during the Lok Sabha Election. The CA exams, scheduled from May 2 to May 17, coincide with the Lok Sabha elections in certain states. The Court stated that postponing the exams one day after the phase-wise polling, as suggested by the petitioners, will cause severe hardship to several students.

Senior Advocate Madhavi Divan, for the petitioners, submitted that it would be difficult for students from interior regions to reach the exam centres the next day after exercising their franchise.

A two-judge bench comprising Chief Justice of India DY Chandrachud, Justice JB Pardiwala and Manoj Misra noted that over 4.36 lakh students have students for the exams and postponing the dates will cause grave hardship.

The bench also noted that a total of 591 exam centres have been arranged across India and that no exams are scheduled on the polling dates. The Court also accepted the ICAI’s submissions that giving opt-out options would prejudice those students who take all papers in a single attempt.
