In a significant case the Kerala high court directed the Income Tax Appellate Tribunal ( ITAT ) to pass an order within a period of two months while staying the assessment order.

In this case the petitioner Reji Krishnan filed an appeal before the CIT(A) against the assessment order passed by the assessing officer. The First Appellate Authority disposed of the appeal by granting partial reliefs to the petitioner. Accordingly the petitioner has preferred a second appeal before Income Tax Appellate Tribunal ( ITAT ). Further the petitioner filed a petition for stay of proceedings pursuant to the assessment order .

After considering the both submissions the single bench judge of Shoba Annamma Eapen directed the ITAT to consider and pass orders on stay petition, within a period of two months from the date of receipt of a copy of this judgment.
