Submission of Soft Copies of Appeal Memos is Optional: CESTAT Temporarily Suspends Amendments in Rules [Read Notification]

The Customs, Excises, Service Taxes Appellate Tribunal (CESTAT), on Saturday after considering the difficulties faced by the Bar Association, the CESTAT directed that the amendments in Rule 9(5), Rule 16(8) and last sentence of Rule 28A(5) of theCustoms, Excises, Service Taxes Appellate Tribunal (Procedure) Rules brought by the Notification dated May 11, 2020, are suspended till further orders.

The Tribunal issued a notification regarding the withholding of amended rules after considering the concerns expressed from the lawyer’s fraternity through Bar Association.

Firstly, Rule 9(5) is suspended till further orders which say, “every Memorandum of Appeal or Cross Objection and the documents filed along with such Appeal or Cross Objection shall be accompanied by its soft copy stored in two pen drives.”

Secondly, Rule 16(8) is suspended till further orders which says, “the soft copies of the Paper Book shall also be stored in two pen drives and filed along with such Paper Book.”

Thirdly, the last sentence of Rule 28A(5) is suspended till further orders which says, “The soft copies of the stay application, the relevant orders, and the documents, shall also be stored in two pen drives and filed along with such application.”

“It is further clarified that the submission of pen drives along with appeal memorandum or applications or paper book, as the case may be, is optional,” the CESTAT notification said.
