Supreme Court disposes of SLP granting Liberty to File Urgent Hearing considering Perishable Nature of Seized Areca Nuts by Customs [Read Judgement]

The Supreme Court disposed of the Special Leave Petition ( SLP) , granting liberty to file for an urgent hearing, considering the perishable nature of the seized areca nuts by Customs department.

The division bench of Justice Radha Sharma and Justice Malekar Nagaraj disposed of this Special Leave Petition reserving liberty to the petitioner herein to seek an early hearing/advance the case/writ petition either for the purpose of seeking an interim relief or for final disposal of the matter.

Mr. Parthiv K Goswami representing the petitioner submitted that even on 29.04.2024, the matter was adjourned. As a result, the petitioner has not been able to seek any interim order in the writ petition particularly having regard to the fact that what has been seized is areca nut which is a perishable commodity.

The bench observed  that if the petitioner seeks urgent hearing for consideration of the interim prayers, the same shall be considered at the earliest, having regard to the nature of the commodity involved in the writ petition so as to save it from perishing as such.

In the circumstances, the Special Leave Petition was disposed of by reserving liberty to the petitioner in the aforesaid terms.
