Tax Audit Due Date Extension: Kerala HC admits Petition, seeks response from Dept

The Kerala High court has today admitted a petition seeking an extension of the tax audit due date and asked the department to file counter affidavit within ten days.

The High Court was considering a bunch of petitions wherein the petitioners sought for a relief of date extension. The matter is adjourned for ten days, without an interim order or direction.

The due date for filing audit report under section 44AB and 115JB of the Income Tax Act, 1961 by all Companies and other Persons (including working partners of such firms) e-File your Income Tax Return (ITR) for A.Y. 2018-19 and 31st October, 2018.

The due date originally fixed was 30th September which was later extended to 15th October and then to 31st October considering the requests of the tax practitioners and the orders of the various High Courts.

The Central board of Direct Taxes (CBDT) last week had confirmed that there will be no further extension of tax audit due date. The Board was considering a representation of Tax Bar Association on extending the tax audit due date in compliance with the direction of the order from Gauhati High Court.

Another petition on a similar issue has been filed by the Tax Bar Association before the Gauhati High Court wherein the Court will hear the matter tomorrow.
