In a recent ruling, the Madras High Court has directed the Commercial TaxesDepartment to take prompt action on a compassionate appointment application filed by an adopted son of a deceased tax officer.
The petitioner, R.K. Guru Hari Haara Suthan, had sought employment on compassionate grounds following the demise of his adoptive father, Mr. S. Sathis Kumar, who was employed in the Department and passed away on March 25, 2021.
Despite multiple representations dated 22.09.2021 and 17.12.2024, the petitioner's request had not been acted upon, prompting him to approach the High Court. The State submitted that the application was returned on April 30, 2025, requesting clarification and supporting documents.
During the hearing, the petitioner’s counsel contended that the prolonged inaction on part of the respondents was arbitrary and unjustified, particularly in a matter that pertains to compassionate consideration.

In response, the Government Advocate representing the department submitted that while the petitioner's application had been acknowledged, it was returned on 30.04.2025, with a request for clarification and submission of certain additional documents necessary for processing.
Justice C. Kumarappan, while disposing of the writ petition, instructed the petitioner to furnish the required documents within four weeks. Thereafter, the commercial Department was directed to consider the application on its merits and in accordance with law within six weeks.
Mr.M.Kempraj appeared for the petitioner and M/s.K.Vasanthamala, Government Advocate (Tax) appeared for the department.
