Apple to Move before Delhi HC against CCI on Behalf of Big Tech Companies

Apple Inc. is to file an appeal against the ruling from India's Competition Commission of India ( CCI ) before the Delhi High Court, said the high court lawyer.

Apple's action is viewed as a preventative measure to safeguard its own strictly regulated iOS ecosystem, even though the CCI's order was mainly intended to punish Google for its anti-competitive activities with its Android operating system.

Last year, the CCI fined Google ₹1,337.76 crore and ordered a number of corrective actions. The most controversial rule mandates that Google permit customers to install third-party app stores on their Android smartphones, a process called "sideloading." According to the regulator, this would encourage competition, give developers an option, and result in cheaper costs for customers.

Apple's involvement is more focused than Google's, which has already filed an appeal against the CCI's full order. The "walled-garden" strategy used by the iPhone manufacturer requires all apps to be released via its exclusive App Store, and Apple collects a commission of up to 30% on numerous purchases. Apple is trying to stop the creation of a legal precedent that would eventually force it to open its own iOS ecosystem by contesting the order to force open the Android platform.

"Apple's filing will be meticulously watched, as its arguments will set a precedent that extends far beyond the iPhone," stated the senior advocate, speaking on condition of anonymity. "They are effectively arguing on behalf of any company that creates and controls a digital platform. The core issue is whether a regulator can compel a platform owner to open up its system to competitors, potentially at the cost of user security and privacy”, reported NDTV.

Apple will contend that the CCI's decision ignores important privacy and security issues related to third-party app shops. It is expected that the company would contend that the stringent review process of the App Store is a crucial element that protects users from fraud, malware, and data misuse. The company is likely to argue that the integrity of the digital ecosystem and customer safety are at risk if platform owners like Google are forced to allow unapproved app stores.

Global regulators are increasingly examining the market dominance of corporations such as Apple and Google, accusing them of limiting competition. In response, the tech behemoths contend that their integrated systems offer a smooth and safe customer experience.
