In a decisive move to safeguard the integrity of legal education, the Bar Council of India (BCI) has issued a sweeping advisory warning students and institutions against enrolling in or offering online and distance LL.M. degrees without its explicit approval. The advisory, authored by Justice Rajendra Menon, former Chief Justice of the Delhi High Court and Co-Chairman of the Standing Committee on Legal Education, was circulated to all High Courts, the Supreme Court, universities, and state bar councils for immediate compliance and action.
The BCI’s letter comes amid a surge in postgraduate law programs delivered through non-traditional formats—such as online, distance, blended, or hybrid modes—by several reputed universities and private centers. Many of these programs use titles like “LL.M. (Professional),” “Executive LL.M.,” or “MSc (Law),” which, according to the BCI, are misleading and lack the mandatory regulatory clearance. The Council underscored that such practices not only violate Supreme Court directives and BCI’s own Legal Education Rules, but also risk eroding the credibility and uniformity of legal education in India.

“It is reiterated that any LL.M. or equivalent legal programme offered in online, distance, blended, or hybrid mode, or under misleading nomenclature such as LL.M. (Professional) or MSc (Law), without prior BCI approval, is unauthorised and shall not be recognised for any purpose whatsoever,” the advisory stated. The BCI made it clear that degrees from such unapproved programs will be treated as “null and void ab initio,” and any reliance on them for employment, academic appointments, research registration, or judicial service will be considered misrepresentation.
The Council is also in the process of issuing show-cause notices to several top law schools, including National Law Institute University Bhopal, IIT Kharagpur, O.P. Jindal Global University, and National Law University Delhi, for running unapproved LL.M. or similar postgraduate courses in online or hybrid formats.
Section 7(1)(h) of the Advocates Act, 1961 empowers the Bar Council of India to promote legal education and set its standards. The Hon’ble Supreme Court had already reinforced this mandate, holding in Vinit Garg v. UGC that no institution can offer any course through online or distance mode without prior approval from the relevant regulator. Similarly, in Odisha Lift Irrigation Corporation Ltd. v. Ravi Shankar Patro, the Court had clarified that even institutions of national importance must obtain such approval, making regulatory compliance mandatory for all.
The BCI’s warning is unequivocal: only LL.M. degrees obtained through programs that have received prior written approval from the Council will be recognized for academic, professional, or judicial purposes. The Council has urged all universities and law institutions to immediately suspend any such unapproved programs and submit compliance reports, reiterating that the LL.M. is a statutorily regulated degree and not a private credential that can be awarded at will.
