The Ministry of Finance, through the Central Board of Direct Taxes (CBDT), issued Notification No. 153/2025 [S.O. 4680(E)] dated October 15, 2025, granting income tax exemption to the U.P. Awas Evam Vikas Parishad. The notification has been published in the Gazette of India (Extraordinary) and will be effective from the Assessment Year 2024-2025.

This decision was taken under the powers conferred by Section 10(46A) of the Income-tax Act, 1961, which allows the Central Government to exempt the income of certain statutory bodies and authorities that perform public functions. The exemption applies to statutory organizations that are established by an Act of Parliament or a State Legislature and operate for non-commercial and public welfare purposes.

The U.P. Awas Evam Vikas Parishad, also known as the Uttar Pradesh Housing and Development Board, is a statutory body constituted under the U.P. Awas Evam Vikas Parishad Adhiniyam, 1965 (U.P. Act No. 1 of 1966). It functions as a housing and urban development agency under the Government of Uttar Pradesh.

The Parishad’s primary objective is to plan and implement housing and infrastructure projects across the state. It focuses on providing affordable housing to different income groups, developing residential and commercial areas, and promoting planned urban growth.

The notification clarifies that the exemption is subject to the condition that the Parishad continues to operate as an authority constituted under the 1965 Act and continues to carry out one or more purposes specified under Section 10(46A)(a) of the Income-tax Act. This means that the exemption remains valid as long as the Parishad performs its statutory functions for public benefit and does not engage in profit-oriented activities.

With this exemption, the income generated by the U.P. Awas Evam Vikas Parishad from its statutory functions, such as housing development, land allotment, and urban infrastructure projects, will not be subject to income tax. The notification also includes a clarification stating that no person will be adversely affected by the retrospective application of this exemption.
