The High Court of Telangana,while addressing the prolonged delay in granting Gazetted status to Deputy State Tax Officers, directed the concerned authorities to consider the petitioner’s representation and take a decision within eight weeks.

Telangana Commercial Taxes,petitioner-assessee, is an association of officers from the Commercial Taxes Department, including those working as Deputy State Tax Officers (earlier Assistant Commercial Tax Officers). These officers handled statutory, executive, and quasi-judicial functions under the Telangana VAT Act and GST Act, such as registration, inspections, levying penalties, and confiscating goods.

Since 2017, the petitioner had been seeking Gazetted status for this cadre. Representations were made on several occasions, including the latest one on 19.05.2025. The Commissioner of Commercial Taxes supported the request through multiple communications.

The First Pay Revision Commission, in its 2020 report, also recommended Gazetted status. Similar posts in other departments, like Deputy Tahsildars and Sub-Registrars, had already been granted such status. The Government of Andhra Pradesh had also extended Gazetted status to GST officers performing similar roles.

Despite repeated representations and official support, the Government had not taken a final decision, leading to the filing of this writ petition.

The assessee counsel requested the Court to direct the respondents to consider the representation submitted on 19.05.2025 and to pass appropriate orders as per law.

The Government Pleader, representing the respondents, did not oppose the submissions made by the assessee counsel.

Justice Namavarapu Rajeshwar Rao considered the submissions made by both sides and, without going into the merits of the case, disposed of the writ petition. It directed respondent Nos. 2 and 4 to consider the petitioner’s representation dated 19.05.2025 and pass appropriate orders as per law within eight weeks from the date of receiving the order.

There was no order on costs, and all pending miscellaneous applications stood closed.
