DRAT transfers Case from Coimbatore to Chennai DRT, directs Expeditious Disposal [Read Order]

The Tribunal directed the DRT, Coimbatore to send all documents with proper index to DRT-III, Chennai within two weeks from the date of receipt of the order.

The Debt Recovery Appellate Tribunal (DRAT), Chennai, has allowed a transfer petition filed on the ground that the incumbent Presiding Officer of DRT, Coimbatore had previously appeared for the petitioners in another case pending before DRAT, Chennai.

The Transfer Petition is filed by petitioners, Mahan Textiles Process India (P) Ltd. and others seeking transfer of SA No.125/2014, pending on the file of Debt Recovery Tribunal (DRT), Coimbatore to any other DRT. The respondent bank is SBI. The reason is that the incumbent Presiding Officer was earlier appearing for the Petitioners in another case pending before DRAT, Chennai.

Counsel for Petitioners prefered that this matter may be transferred to any of the DRTs at Chennai.

DRAT dismisses IDFC First Bank's Appeal in Default Due to Non-Representation [Read Order]

The Tribunal directed the DRT, Coimbatore to send all documents with proper index to DRT-III, Chennai within two weeks from the date of receipt of the order. Upon receipt of the documents, the Presiding Officer of DRT-III, Chennai was directed to decide SA No.125/2014 on merits and in accordance with law, after providing opportunity to both parties, as expeditiously as possible.

The single bench of Justice G.Chandrasekharan, Chairperson, allowed the transfer petition with no order as to costs, and all pending interim applications, if any, were closed. The transfer was necessitated to ensure impartiality in the proceedings, given the previous professional relationship between the Presiding Officer and the petitioners.
