In a recent order, the Gauhati High Court has made absolute the interim bail earlier granted to a trader from Assam, who was accused in connection with a GST ( Goods and Services Tax ) matter.

The Court, while granting bail, stated the requirement for full cooperation with the investigating authorities.

The petitioner, proprietor of M/s Makalyani Forest Produce Trading Depot, had been granted interim protection by the Court on 26.06.2025, pending further investigation into allegations involving unaccounted GST transactions.

As per the status report submitted by the Investigating Officer on 29.07.2025, the petitioner had appeared before the authorities and recorded his statement. However, he failed to produce certain critical documents such as CGST bills and cash transaction records, which he had been specifically directed to submit during his appearance.

The investigating agency noted discrepancies in the petitioner’s statement, particularly his denial of a consignment transaction in 2024, despite the complainant submitting complete GST bills and e-way bills to support the charge.

Justice Yarenjungla Longkumer took note of the petitioner’s initial appearance and ongoing cooperation. It was also brought to the Court's attention that the co-accused individuals had already been granted bail in the same case by a Coordinate Bench on 10.07.2025.

The bench decided to confirm the interim relief.
