Prosecution under GST is a serious legal proceeding initiated in cases of tax evasion, fraudulent refunds, or other willful violations of GSTprovisions. Receiving a prosecution notice can have legal implications, including criminal charges. As such, having an easy method to access these notices is essential for compliance and legal preparedness.

Here is a comprehensive article to help taxpayers understand how to navigate the GST portal and view any prosecution notices issued against them.

To access prosecution notices, taxpayers must first visit the GST portal at www.gst.gov.in. The user must log in using valid credentials, after which the dashboard becomes accessible.

From the dashboard, users need to navigate to the ‘Services’ tab, then proceed to ‘User Services’ and click on ‘View Additional Notices/Orders’. This pathway leads to a page that lists all notices and orders issued by tax authorities in descending order of issuance. Users can search through this list using navigation buttons to locate the relevant notice.

Once the user identifies the relevant entry under the ‘Type of Notice/Order’, they should click on the ‘View’ hyperlink to open the case details screen.

Accessing and Downloading Prosecution Documents

Upon reaching the Case Details page, the system defaults to the ‘NOTICES’ tab. Here, users will find a table displaying prosecution notices issued in relation to their GST profile. Each entry in the table provides details such as the reference number, date of issuance, and description of the notice.

Users can download individual documents associated with the notice by clicking the respective document names listed under the ‘Documents’ section of the table. These documents can then be saved for personal records or forwarded to legal advisors for further action.

Once a prosecution notice has been issued, the status of the case will be displayed as “Complaint filed”. This indicates that the tax department has initiated legal proceedings against the taxpayer. The status will change to “Closed” only under specific circumstances, signaling the end of the prosecution process.

Closure of the case can occur under the following conditions:

Compounding of Offence: If the taxpayer files an application for compounding the offence and the Commissioner allows it, the taxpayer must pay the compounding amount, which includes tax, interest, and penalties, within the specified timeframe. If a private complaint has already been filed with a court, it will be withdrawn or considered abated under Section 138 of the CGST Act.

No Complaint Filed Yet: If the taxpayer pays the compounding amount before a complaint is filed with the court, the case is closed with no further legal action.

Court Ruling: If the complaint filed in court is set aside by the judicial authority, the status is updated to closed.

Compliance with Court Order: If the taxpayer complies fully with a court-issued order, the case is similarly closed.

These updates are critical for taxpayers to monitor, as they affect legal obligations and future compliance requirements.

Taxpayers are encouraged to regularly log in to the GST portal to stay updated on any notices, particularly prosecution notices, which may require immediate legal action. Failure to respond appropriately to such notices can lead to escalation, including court proceedings and financial penalties.

Businesses, especially those operating across multiple states or involved in high-value transactions, should consider assigning compliance officers or using automated notification services to monitor their GST dashboards for new notices or updates to existing cases.

A Step Toward Transparency and Accountability

The facility to view prosecution notices on the GST portal aligns with the government’s larger goal of promoting digital governance and transparency. By providing an accessible platform for managing legal communications, the portal empowers taxpayers to remain informed and compliant.

With prosecution being one of the most stringent enforcement tools available to tax authorities, timely awareness and response are crucial. The GST portal’s user-friendly interface for viewing such notices is a step forward in reducing litigation and encouraging voluntary compliance.

As GST compliance becomes more data-driven and automated, the ability to manage notices digitally not only saves time but also ensures that taxpayers are not caught off guard by legal actions. It is advisable for all GST-registered entities to familiarize themselves with this functionality and make it a routine part of their tax management process.

Conclusion

Understanding how to view prosecution notices on the GST portal is not just a procedural necessity, it is a legal safeguard. Staying alert and informed can mean the difference between a resolved case and an escalated one. Make sure your business is equipped to respond promptly and appropriately.
