The First Appellate Authority of the Insolvency and Bankruptcy Board of India (IBBI) acknowledged that there was a delay of one day in responding to an RTI application by the Central Public Information Officer (CPIO), but found no reason to intervene in the CPIO’s reply.

Ramesh Chandra, the appellant, had filed an RTI application on 24 May 2025 seeking information related to the action taken by IBBI pursuant to the Ministry of MSME’s RTI reply dated 7 January 2025, certain High Court orders dated 7 August 2024 and 7 October 2024, and an order suspending insolvency professional Vivek Raheja.

The appellant also asked for information regarding the steps taken by IBBI to verify MSME certificates and any follow-up action after receiving clarification from the concerned ministry.

The CPIO of IBBI responded on 24 June 2025. The appellant subsequently filed a first appeal on 28 June 2025, arguing that the CPIO’s response was delayed and issued beyond the 30-day time limit prescribed under Section 7(1) of the RTI Act. The appellant stated that the deadline expired on 23 June 2025 and that the delay warranted intervention.

The First Appellate Authority examined the RTI application, the CPIO’s response, and the grounds raised in the appeal. The authority explained that under Section 2(f) of the RTI Act, the term “information” includes material in any form that is held by or is under the control of a public authority, and the right to such information is subject to the conditions of the Act.

The authority acknowledged that the CPIO responded one day beyond the 30-day statutory period and stated that such delay is not in compliance with Section 7(1) of the RTI Act. The authority pointed out that being part of a public authority like IBBI, the CPIO is expected to adhere strictly to statutory timelines while handling information requests.

At the same time, the authority explained that the information sought by the appellant had been provided and no further deficiency in the response was pointed out, so there was no need to interfere with the CPIO’s reply. The authority urged the CPIO to ensure strict compliance with RTI timelines in future. The appeal was disposed of without any direction to revise the CPIO’s response.
