ICAI removes CA from Register for 3 Years Following Karnataka HC’s Order [Read Notification]

The misconduct falls within the ambit of Clause (7) of Part I of the Second Schedule, read with Clause (ii) of Part II of the Second Schedule to the Chartered Accountants Act, 1949.

The Institute of Chartered Accountants of India ( ICAI ) has removed a Chartered Accountant from the Register of Members for a period of three years, in accordance with an order passed by the Karnataka High Court holding him guilty of professional misconduct under the Chartered Accountants Act, 1949.

According to the notification issued by ICAI on November 4, 2025, and published in the Gazette of India (Extraordinary, Part III – Section 4), the decision follows the order dated July 29, 2025, passed by a Division Bench of the High Court of Karnataka under Section 21(6)(c) of the Chartered Accountants Act, 1949.

The High Court directed that the name of Manish Agarwal, Chartered Accountant, be removed from the Register of Members for a period of three years, after finding him guilty of professional misconduct.

The misconduct falls within the ambit of Clause (7) of Part I of the Second Schedule, read with Clause (ii) of Part II of the Second Schedule to the Chartered Accountants Act, 1949.

The Clause (7) of Part I of the Second Schedule deals with misconduct by a Chartered Accountant in practice and generally covers situations where a Chartered Accountant does not exercise due diligence or is grossly negligent in the conduct of professional duties.

The clause (ii) of Part II of the Second Schedule applies when a member (in practice or otherwise) is found guilty of misconduct not directly professional but affecting the reputation or discipline of the profession.

The ICAI stated that “Now, therefore, pursuant to the said order of the Hon’ble Karnataka High Court dt. 29.07.2025 and in terms of sub-section (2) of section 20 of the said Act read with Regulation 18 of the Chartered Accountants Regulations, 1988, it is hereby notified that the name of Shri Manish Agarwal (M.NO. 208588) stands removed from the Register of Members for a period of three years w.e.f. the date of publication of this notification.”
