In a recent order, the Gujarat High Court heard a petition filed by the Chartered Accountants Association, Surat (CAAS) and others raising issues regarding delay in making income tax return (ITR) forms and utilities available for e-filing.
The case began after the petitioner association argued that despite a judgment dated 29.09.2015 in Special Civil Application No. 15075 of 2015, the Income Tax Department had failed to ensure that forms and utilities for e-filing of returns are made available on the 1st day of April of the relevant assessment year. The counsel argued that even after 11 years, the department was not following these directions.

The Division Bench comprising Justice A.S. Supehia and Justice Pranav Trivedi observed that the petition raised serious issues relating to the functioning of the respondent department. The Court observed,
“the petitioner has raised very serious issues relating to the functioning of the respondent-Department and the hurdles faced due to non-compliance with the orders of this Court as well as due to the lack of proper technical monitoring of the portal.”
The court also recorded that the learned Senior Standing Counsel informed that there were various other orders of the Court which were not being followed.
In view of this, the court directed the respondents to file an affidavit before the next date of hearing suggesting measures to resolve the issues raised in the petition. The court stated,

“we direct the respondents to file an affidavit by before the next date of hearing suggesting measures to resolve the issues raised in the present writ petition, failing which this Court shall take a serious view in the matter.”
The court also directed the Registry to delete the name of Mr. Chaitanya S. Joshi from the record as he was not appearing on behalf of the respondents.
The matter has been listed for further hearing on 27.04.2026.
