India and Morocco Sign Legal Cooperation Agreements: Enables Cross-Border Enforcement of Judicial Summons, Settlements and Arbitral Awards

India and Morocco have formalised a significant step in bilateral legal cooperation through the signing of a Mutual Legal Assistance Treaty (MLAT) to enable cross-border collaboration in civil and commercial legal matters.
The agreement which was executed between India’s Ministry of Law & Justice and the Kingdom of Morocco’s Ministry of Justice seeks to establish a framework to streamline judicial processes across the two nations.

Among the key provisions of the agreement, a key feature is a mechanism to facilitate service of judicial summons and legal documents to ensure smoother legal procedures in transnational disputes.
The agreement also empowers authorities in both nations to gather evidence via Letters of Request, enabling courts in one country to secure documents or testimony located in the other, in accordance with each nation's legal protocol.
The most notable element, however, is that the agreement facilitates the execution of judicial judgments in Morocco and decrees in India as well as mutual recognition and enforcement of civil settlements and arbitral awards.
In addition to the MLAT, both nations have inked a Memorandum of Understanding (MoU) to encourage knowledge sharing, exchange of legal publications and cooperation on training and capacity-building programs.
The agreement also proposes the joint organisation of legal conferences and information exchange between legal professionals from both countries. In line with the growing technological advancements around the globe, the agreement also suggests collaboration between both nations to develop each others’ national legal information systems and digital tools.
Is this India’s first Bilateral Legal Cooperation Agreement?
India has entered into similar treaties with several countries including France, Russia, UAE and South Korea among others. In the criminal law sphere, over forty Mutual Legal Assistance Treaties are in force with countries such as the United States, United Kingdom and Australia. The Morocco agreement is a timely addition, aligning with India’s goal of building reliable and reciprocal legal frameworks with key global partners.
The India-Morocco agreement also marks a broader diplomatic effort to expand India’s legal cooperation footprint beyond South Asia, with Morocco emerging as a strategic partner in the North African region.
