Kerala HC Grants Bail to Man arrested with 2.4kg Ganja from Thailand

The Kerala High Court granted bail to a man arrested for the alleged possession of 2.4 kg of ganja. The court found that considering the stage of the investigation and the time already spent in custody, the petitioner was entitled to be released on bail with conditions.
Sachria Titus, the applicant, was arrested on September 18, 2025, by officers of the Special Intelligence & Investigation Branch of the Customs House in Cochin. The prosecution's case is that he was intercepted at the Foreign Post Office while attempting to collect a parcel sent from Thailand containing 2.40 kg of ganja. He was charged under several sections of the Narcotic Drugs and Psychotropic Substances (NDPS) Act and had been in judicial custody since his arrest.

The petitioner's counsel argued for bail, stating that the investigation was practically complete and that his continued detention was no longer necessary. The Special Public Prosecutor, representing the Customs department, opposed the bail application.
Justice K. Babu, in his order, noted two key factors in favour of the petitioner: firstly, that he had no prior criminal antecedents, and secondly, that the case diary indicated the investigation was in its final stages. Considering the advanced stage of the investigation and the period of judicial custody already undergone by the petitioner, the judge concluded that he was entitled to be released on bail, subject to certain conditions.
Consequently, the court allowed the bail application. The petitioner was ordered to be released upon executing a bond for Rs. 50,000 with two sureties.
