The Ministry ofCorporate Affairs (MCA) has formally amended the constitution of the Appellate Authority constituted under Section 22A of the Chartered Accountants Act, 1949, Section 22A of the Cost Accountants Act, 1959, and Section 22A of the Company Secretaries Act, 1980.

The latest amendment, notified through G.S.R. 433(E) and published in the Gazette of India on June 30, 2025, introduces a change in the constitution of the membership of the high-level appellate body.

In exercise of its statutory powers, the Central Government has substituted the entry at serial number (2) of the Authority with the appointment of
Shri Chaitanya Prasad, IAS (1990) - Member”.

The Appellate Authority, originally constituted by notification G.S.R. 835(E) dated November 3, 2015, is empowered to hear appeals in disciplinary matters under the Chartered Accountants Act, the Cost Accountants Act, and the Company Secretaries Act.
The appellate authority serves as an independent forum for reviewing decisions made by the disciplinary committees of the Institute of Chartered Accountants of India, the Institute of Cost Accountants of India, and the Institute of Company Secretaries of India.
The Authority consists of a Chairperson and members drawn from the judiciary, administration, and professional fields, as a measure to ensure an impartial and multi-disciplinary approach to appellate proceedings.
The inclusion of Chaitanya Prasad, an accomplished Indian Administrative Service officer of the 1990 batch, is a part of the government’s ongoing efforts to bring experienced leadership and administrative expertise to statutory bodies that regulate the professional landscape in India. The appointment is slated to further strengthen the governance, transparency, and efficiency of the appellate process under these three key Acts.
The notification, issued under the signature of Inder Deep Singh Dhariwal, Joint Secretary, forms part of a series of periodic updates undertaken by the Ministry of Corporate Affairs to maintain the efficacy and contemporary relevance of statutory authorities. The updated constitution of the Appellate Authority, as reflected in the latest notification, will govern all matters coming before it from June 30, 2025 onwards.
