Mentioning Names of Judges while citing Judgments in Affidavits is Uncalled For: Allahabad HC [Read Order]
The High Court observed that mentioning names of judges while citing judgments in affidavits or pleadings is uncalled for and directed authorities and courts to avoid the practice.

In a recent ruling, the Allahabad High Court observed that mentioning the names of judges while citing judgments in affidavits and pleadings is uncalled for and unnecessary.
The case arose during the hearing of a bail application filed by Alice Lee @ Li Tengli, a Chinese national, seeking bail in connection with a case registered under various provisions of the CGST Act, 2017 relating to alleged GST evasion by Tentech LED Display Pvt. Ltd. The applicant was arrested on 26 August 2025 and had been in judicial custody since then.

During the proceedings, the Court examined the counter affidavit filed by an Assistant Commissioner of CGST. While referring to various judgments of the Supreme Court and High Courts in the affidavit, the officer had also mentioned the names of the judges who constituted the benches that delivered those decisions.
Justice Samit Gopal observed that this practice of mentioning the names of judges while citing judgments is totally uncalled for. The court explained that while referring to judgments, only the names of the parties, the date of decision, case details or citation, and the relevant portion of the judgment are required to be mentioned.
The court further observed that even the trial court while deciding the earlier bail application had mentioned the names of the judges of the Supreme Court while referring to precedents. The court pointed out that such practice should be avoided in court proceedings.
In view of this, the court directed the concerned officer as well as the presiding officer of the trial court to remain cautious in future and ensure that the names of judges are not mentioned while citing judgments.
The Registrar (Compliance) was also directed to communicate the order to the District and Sessions Judge, Gautam Budh Nagar and to the Director General of CGST for necessary compliance and awareness.
