Nestlé India Receives ₹16.56 Crore GST Demand Order u/s 74 of CGST

Nestlé India Limited, one of India's leading food and beverage companies, has disclosed that it received a GST demand order under Section 74 of the Central Goods and Services Tax Act, 2017 (CGST Act) of ₹16.56 crore from the Office of the Commissioner of GST and Central Excise, Chennai on December 1, 2025 for the tax period 2018-2023.

According to the official disclosure, the demand comprises:

  • ₹8.28 crore in tax liability
  • Applicable interest on the tax amount
  • ₹8.28 crore in penalty

The order was passed under Section 74 of the CGST Act, 2017, which deals with determination of tax not paid or short paid or erroneously refunded or input tax credit wrongly availed or utilized by reason of fraud or any willful misstatement or suppression of facts. The order pertains to alleged violations or contraventions committed during the specified tax period spanning five years.

In its filing to the stock exchanges, Nestlé India stated that there is no material impact on the company's financials, operations, or other activities on account of this order. The company has indicated that it will explore various options to challenge the order through appropriate legal channels.

The disclosure was made in compliance with Regulation 30 and Schedule III of the SEBI (Listing Obligations and Disclosure Requirements) Regulations, 2015, which mandate listed entities to inform stock exchanges about any material developments, including tax demands and orders from regulatory authorities.
