In a recent order, the Supreme Court of India directed the Central Bureau of Investigation to examine the authenticity of an advocate’s Bachelor of Commerce degree after Magadh University reported that the certificate was forged.

The case arose in a civil appeal filed by Naresh Dilawari against Charanjit Singh Oberoi. During the proceedings, the BarCouncil of Punjab and Haryana placed on record a communication from the Controller of Examinations, Magadh University, which stated that the mark-sheet and degree in the name of Naresh Dilawari for the B.Com (Honours) examination of 1991 were fake and not issued by the University.

The petitioner, appearing in person, filed a photocopy of the B.Com degree said to have been issued by Magadh University in August 1991. The counsel argued that the University’s records had been damaged and torn and because of this the degree may not be verifiable from the available documents.

The respondent’s counsel argued that the University’s official verification clearly declared the petitioner’s degree and mark-sheet to be forged. They relied on the letter from the Controller of Examinations to submit that no valid certificate had ever been issued to the appellant.

The bench comprising Justice Manoj Misra and Justice Ujjal Bhuyan observed that the genuineness of the petitioner’s degree was in serious doubt. The court explained that as the issue touched upon the veracity of educational qualifications, it required an independent investigation by a central agency.

The court directed the Director of the Central Bureau of Investigation in Delhi to depute an officer to conduct an inquiry and to report on whether the degree relied upon by Naresh Dilawari was genuine or forged. The order also required the CBI to submit its findings on or before 30 November 2025.

The case has been listed for further hearing on 9 December 2025 along with the CBI’s report.
