Typographical error in Application made for Defreezing Saving Account : DRAT allows to rectify Error
So far as the extension of interim order dated 03.03.2023 is concerned, the same cannot be extended because the present application has been filed only for correction in the order dated 19.04.2024, which is typographical error in nature

In a recent case, the Allahabad bench of the Debt Recovery Appellate Tribunal(DRAT) allowed to rectify the typographical error in the application made for defreezing the savings account.
Yashwant Singh filed the appeal under Section 20 of the RDB Act, 1993 against the judgment and decree dated 14.12.2012 passed by the Tribunal below.
It appears that an interim application no. 335/2024 was filed by the appellant for defreezing the saving account of the appellant, which was frozen by the Recovery Officer and instead of the same, the main appeal i.e. Regular Appeal No. 172/2018 was disposed off by this Appellate Tribunal vide order dated 19.04.2024, therefore, the present correction application has been filed by the appellant with request to correct as under:"The word appeal be corrected as "application" in the first line of fourth paragraph of order dated 19.04.2024 and in the top of order words "Regular Appeal No. 172/2024" be corrected as I.A. No. 335/2024 and the interim order dated 03.03.2023 continued till 08.04.2024 may kindly be revived".

The aforesaid correction as sought by the appellant is a typographical mistake, except the extension of interim order dated 03.03.2023, therefore, it is ordered that the word "Regular Appeal" be read as "application" in the first line of fourth paragraph of order dated 19.04.2024 and in the top of order words "Regular Appeal No. 172/2024" be read as Interim Application No. 335/2024".

In view of the aforesaid, Justice R.D. Khare Chairperson allowed the correction application only the extent of correction as sought.
