The Central Board of Indirect Taxes and Customs (CBIC) has notified the Controlled Delivery (Customs) Regulations, 2022.

The Government has proposed to introduce the Controlled Delivery (Customs) Regulations, 2022, to track down individuals engaged in the transportation of products like gold, silver, precious and semi-precious stones, currency, antiques, and various other goods.

The regulations further intends to identify the person suspected of being engaged in the commission of an offense in connection to the consignment, the customs officer may, if necessary, mark or place tracking devices on consignments of the aforementioned commodities before completing the delivery of such goods.

“Upon receiving the approval of the specified authority to undertake controlled delivery, the proper officer may, if required, affix any mark or install any special investigative tools, including devices for track-and-trace monitoring of the suspect consignment, during the course of controlled delivery operation, without impacting or tampering with the nature of the said consignment as far as possible,” the notification said.

As per the notification, the customs officer must seek approval as soon as possible, but no later than 72 hours after making the controlled delivery, if the officer is unable to get it before doing so.

The notification further mandates that if such a delivery is stopped before it is finished, the officer should respond as necessary.
