The 50th Goods and Services Tax (GST) council meeting headed by Union Finance Minister Nirmala Sitharaman is likely to be held in the last week of June or first week of July and is expected to approve the 50 appellate tribunal branches all over India.

As per the reports, the coming GST council meeting has a high chance to approve the number of appellate tribunal branches and the appointment of the officers in each state. The Good and Services Tax Appellate Tribunal (GSTAT) has not yet formed since the implementation of the Goods and Services Tax Act. 

The number of benches will be suggested by each state based on its population. The states can also suggest what number of benches they think are necessary. However, the GST council will legally ratify the entire amount at its forthcoming meeting.

The High Courts and Supreme Court have had trouble with the GST appellate tribunal. Since there are no tribunals to hear the grievances, the taxpayers turned to the courts for resolution of their GST-related disputes. The Central Government was under constant pressure from the Supreme Court and other high courts.

Recently, the Calcutta High Court (HC) stayed the recovery proceedings as no prejudice to the taxpayer was caused by non-formation of the Goods and Service Tax Appellate Tribunal (GSTAT). Also directed the authorities not to take any coercive steps against the taxpayer.

A group of industrialists requested the central government to adopt a temporary provision to accept the appeal by accepting a partial amount from the taxpayer. The industrialists also suggested that as an interim fix, the department accept the taxpayer’s appeal and withhold 20% of the total amount due from the assessment.
