The  Delhi High Court allowed the petitioner assessee to approach the National Company Law Tribunal ( NCLT ) as the assessee was not appealing against the scheduled e-auction due to the Closure of the NCLT.

Ashok Chaturbhuj Bhatia, the petitioner submitted that e-auction is scheduled for tomorrow but is constrained to file a Writ Petition as he is in no position to move NCLT as it would reopen 01.04.2024 only. During the arguments, it was prayed for relief for the interregnum only so that he could approach NCLT where liquidation proceedings are pending.

Sh. Raghav Chadha, counsel has put in an appearance on behalf of respondent nos. 3 & 4. He admitted that the auction is due tomorrow but since the NCLT, Delhi would reopen only on 01.04.2024, they would keep the auction, concerning the property in question, on hold for one week, to enable the petitioner to approach NCLT.

Justice Manoj Jain held that “the petitioner would be at liberty to approach NCLT within one week from today and as undertaken, the auction of property in question, shall remain on hold till then only.”

The court disposed of the writ petition in the aforesaid terms.
