The Madurai bench of Madras High Court has directed the Commissioner of Commercial Taxes ( CCT ) to consider a representation by an Assistant in the Commercial Taxes Department seeking promotion to the post of Deputy Commercial Taxes Officer.
A Muthupandi, the petitioner contended that his qualifications, including a B. Cop (Junior Grade Accountancy) certification, are equivalent to a B. Com degree and fulfill the eligibility criteria for the promotion.
Despite being qualified, the petitioner alleged that he was denied for promotion and submitted a representation dated September 25, 2021, to the authorities.

The petitioner submitted that The Tamil Nadu State Council for Higher Education confirmed that the petitioner’s qualifications are equivalent to the educational requirement for the Deputy Commercial Taxes Officer post.
However, the promotion remains contingent upon the petitioner meeting other merit-based criteria, submitted by the petitioner.
Justice Abdul Quddhose noted that considering the petitioner’s representation would not prejudice the respondents and directed the first respondent to review and decide on the matter within 12 weeks.
The Court clarified that it was not expressing any opinion on the merits of the representation, leaving the decision to the concerned authority.
The case was filed against the The Principal Secretary / Commissioner of Commercial Taxes, The Joint Commissioner, The Deputy Commissioner, The Assistant Commissioner of Commercial Taxes (State Taxes), The Secretary of Tamil Nadu Public Service Commission, The Registrar of The Gandhigram Rural Institute, Deemed University Gandhigram and The Personal Assistant To Principal Secretary to Government of Higher Education Department.
Mr. V .Palanichamy appeared for the petitioner and Mr.R.Sureshkumar (R1 to R4) Additional Government Pleader Mr.V.Panneerselvam (R5), Mr.Ma.Pa.Thangavel, (R6) Mr.T.Amjad Khan (R7) Government Advocate appeared for the respondents.
