Jaipur Bench of Rajasthan High Court has recently granted bail to GST evaded accused on deposit of Rupees One lakh.

The bail application was filed by the accused for seeking regular bail Under Section 439 of the Criminal Procedure Code, 1973 for the offense under  Section 132(1) of the Rajasthan Goods and Services Tax Act, 2017 .The Accused was arrested for evading rupees Rs.43 crores,

The counsel for the petitioner Advocate Swadeep Singh Hora contended that the alleged tax evasion amount has already been deposited by the recipient. He has been in custody since 08.11.2022, and the offenses in the charge sheet are compoundable ; the maximum sentence awardable is five years.

 On behalf of the respondent Kinshuk Jain submitted that deposition of the evaded tax is itself evident of the culpability of the petitioner and prayed for rejection of the bail.

 After considering the contention of both sides, the bench of Justice Mahendar Kumar Goyal granted bail to all the accused furnishing a personal bond in the sum of Rupees One lakh along  with two sureties.
