The Delhi High Court quashed the summons issued by the Additional Chief Metropolitan Magistrate (ACMM), Patiala House Courts, New Delhi, for not taking cognizance or any directions for issuing the summons against the petitioner.
The petitioner company M/s Global Infocom Limited, represented by Mr. Mudit Gupta, Mr. Lakshay Virvani and Ms. Pranaya Sahay, challenged the summons on the grounds that the Patiala Court had not taken cognizance of the complaint and had not issued any specific orders for summoning the petitioner.
The bench of Justice Anoop Kumar Mendiratta, found merit in the petitioner’s contentions, noting that the summons appeared to be issued without following proper procedure.
The Court also considered the fact that the Principal Commissioner of Customs (Import), initiating the customs case had already dropped proceedings against the company in a separate order.
The court directed the petitioner to bring the facts to the attention of the Additional Chief Metropolitan Magistrate. The court can then consider the relevant orders and decide whether to reissue the summons.
