GST Consultant alleged to Have Sold GST Receipts, Invoices etc. to Other Firm: Allahabad HC Finds Allegations Worth Probing, Dismisses Petition [Read Order]

The petitioner, Raviraj Soni alias Ravi Karan Soni who had been engaged by the complainant to handle Goods and Services Tax ( GST ) compliances, allegedly sold the complainant’s GST receipts, invoices, and related documents to third-party firms. This act allegedly resulted in wrongful gain to the petitioner and corresponding financial loss and deceit to the informant.

A division bench comprising Justice J.J. Munir and Hon’ble Justice Anil Kumar-X observed that the contents of the FIR disclose cognizable offences that merit investigation.

The Court held that the allegations are not prima facie absurd or mala fide so as to warrant interference under its writ jurisdiction. Finding no grounds to quash the FIR, the High Court dismissed the petition summarily, allowing the investigation to proceed.

Rejecting the plea for quashing, the Court observed: “Considering the allegations in the First Information Report, it cannot be said that no offence worth investigation is made out, or that the allegations are utterly incredible or mala fide. In this view of the matter, we do not find it a fit case to interfere with the impugned FIR.”
