The Goods and Services Tax (GST) council has announced that the 50th GST council meeting is to be held on 11th July 2023 at Vigyan Bhawan, New Delhi.

As per the reports, the main agenda for the meeting will be the taxation issues of online gaming, horse racing and casinos. Also there will be significant progress in the set up of the Goods and Services Tax Appellate Tribunal (GSTAT).

As per the reports, the coming GST council meeting has a high chance to approve the appellate tribunal branches and the appointment of the officers in each state. It is likely to approve 50 appellate branches all over the nation. The Good and Services Tax Appellate Tribunal (GSTAT) has not yet formed since the implementation of the Goods and Services Tax Act.

All actionable claims concerning betting and gambling, including those involving online gaming, are currently subject to a 28% GST. When calculating the charge, the GST Act does not distinguish between games of skill and games of chance.

Following a recent ruling by the Karnataka High Court, which overturned a Rs. 21,000 crore GST notice given to an online gaming company called Gameskraft, the online gaming and betting application issue has a significant importance.

Recently, the former Chairperson of Central Board of Indirect Taxes (CBIC) John Joseph has stated that the CBIC should differentiate between skill-based and chance-based online games before coming up with a new tax rate.
