The court held that a GST appellate authority must independently consider the grounds of appeal and cannot simply repeat the adjudicating officer’s findings without reasons.

Assessee had obtained the certificates from the embassies, even though some were furnished after adjudication. Therefore the tribunal’s decision to remand is proper.

The High Court held that a single judge must consider all the vital issues must be decided after a remand by a Division Bench.
