The Anti-evasion wing of CGST Bhiwandi Commissionerate, on March 22, 2023, Mr. Mahendra Kumar Rawat, the Authorized Signatory and Manager-Finance & Accounts of M/s. Oppo Mobiles India Private Limited, for fraudulent availment of Input Tax Credit (ITC) worth Rs. 19 crore.
The officers of CGST Bhiwandi Commissionerate in Mumbai Zone took Mr. Rawat into custody, and he will remain in judicial custody until April 3, 2023. Mr. Rawat was arrested under section 69 of the CGST Act, 2017 for contravention of section 132 of the same act.
According to the investigation conducted by CGST Bhiwandi Commissionerate, M/s. Oppo Mobiles India Private Limited was involved in fraudulent availment of ITC without receipt of any goods.
The investigation revealed that sixteen e- way bills for the said transaction were verified and found to be fake. Further, statements of the transporters and vehicle owners were recorded wherein it was revealed that there was no supply of goods to OPPO Maharashtra. Furthermore, statements of the transporters and vehicle owners revealed that there was no supply of goods to M/s. Oppo Mobiles India Private Limited. The investigation further revealed that the supplier of M/s. Oppo Mobiles India Pvt ltd, M/S Gain Hero India Private Limited, was non-existent at its principal place of business
Mr. Rawat was the main person responsible for availing the fraudulent ITC worth Rs. 19,27,54,093/- against the invoices amounting to Rs. 107,08,56,072/- issued by Gain Hero India Private Limited, without receipt of the goods. He admitted in his statement that the e-way bills generated were fake.
The CGST Mumbai Zone has launched a special drive against tax fraudsters and tax evaders, and this case is part of the same drive.
