In a recent ruling, the Kerala High Court intervened in a long-standing income tax dispute, directing the Income Tax Department to expedite the hearing on a stay petition filed by the petitioner. The petitioner is contesting an assessment order issued by the department for the year 2013-2014.
Mr. K.P. Pradeep, Mr. T.T. Biju, Ms. T. Thasmi, and Ms. M.J. Anoopa, on behalf of the petitioner, stated that the petitioner had filed an appeal along with a stay petition, requesting abeyance on any further actions related to collecting the tax until the appeal is heard. The appeal and stay petition are currently pending before the National Faceless Appeal Centre ( NFAC ).
After considering the arguments put forth by both parties, the bench of Justice Viju Abraham directed the Appeal Centre to prioritise the stay petition filed by the petitioner and deliver a decision within two months from the date of receipt of a copy of the judgement.
Accordingly, the court disposed of the writ petition mandating all actions based on the original assessment order be put on hold until the department reached a decision on the stay petition.
