Delay of 422 days: Supreme Court dismisses SLP by Income Tax Dept

The Supreme Court dismissed a special leave petition (SLP) filed by the Income Tax Department with adely of 422 days

The petitioner in the present matter is Ketan Kumar J Patel. The counsel appearing for the petitioner submitted that although there is a delay of 422 days in SLP (C) Dy.No.29859/2023, 524 days in SLP (C) Diary No(s). 45805/2023 and 524 days in SLP (C) Dy. No.45797/2023 in filing these special leave petitions, nevertheless the matters are covered by the order of the Supreme Court passed in SLP (C) No.13121/2023 disposed of dated 03.07.2023 by which similar special leave petition(s) has been dismissed.

A Two-Judge Bench comprising Justice BV Nagarathna and Justice Ujjal Bhuyan observed that “Hence, appropriate order may be made in these special leave petitions. The special leave petitions are dismissed both on the ground of delay as well as on merits following the order referred to above.”
